  1. The Court of Appeals erred in affirming the trial court’s denial of Taylor’s motion to strike the charge of attempted identity theft under Va. Code § 18.2-186.3, where the Commonwealth’s evidence was insufficient as a matter of law to prove the elements of attempted identity theft, where Jermica Taylor endorsed her own name on the back side of the check and never misrepresented her identity to the bank teller while attempting to cash the check.
