  1. The Court of Appeals erred in finding no error where the trial Court erred in not allowing Counsel to finish cross-examining the Commonwealth’s witness about the alleged overpayment.

The Court of Appeals erred in finding no error where the trial Court erred in denying Counsel’s Motion to Strike on the grounds of insufficient evidence for a showing that the defendant received an overpayment of two hundred dollars or more, thereby making it a felony as opposed to a misdemeanor.
